IMPORTANT - Read carefully. This is a legal agreement between you and Institute of Mathematics and Statistics (IMS) for the software product identified above, which includes computer software and documentation. LICENSE GRANT: Subject to the terms and conditions of this Agreement, IMS hereby grants to you a personal, non-exclusive, non-transferable license (a "License") to use the software product identified above (the "MultiplexCalc Software") and the documentation on the terms set forth below. Larry Nylund (at the Institute of Mathematics and Statistics) reserves all rights to the software not expressly granted to you.
1. SCOPE OF LICENSE. This license grants you the following rights:
SOFTWARE: The software is provided under a single-user license. A single individual may use the software on a single computer. A license for the software may not be shared by multiple individuals on a single computer or used concurrently on different computers.
REVERSE ENGINEERING: You may not modify, translate, reverse engineer, decompile, disassemble (except to the extent applicable laws specifically prohibit such restrictions) or create derivative works based on the software or any portion thereof.
SEPARATION OF COMPONENTS: The software is licensed as a single product. You may not separate the software's component parts for use on more than one computer.
TRANSFER: You may not rent, lease, lend or otherwise temporarily transfer the software, but you may transfer the software and documentation together on a permanent basis provided you retain no copies and the recipient agrees to the terms of this End-User License Agreement.
PROPRIETARY NOTICES: You may not remove any proprietary notices, labels or marks on the software or documentation.
All title, ownership rights, and intellectual property rights in and to the software and documentation are vested in Larry Nylund at the Institute of Mathematics and Statistics. The copyright laws and international treaties protect the software and documentation.
The license is in effect until terminated. You may terminate this license by ceasing any use of the software and documentation, and deleting or otherwise destroying the software and documentation. The license will terminate immediately and automatically if you breach any of the terms of this Agreement or otherwise fail to comply with the limitations described herein.
The software and documentation are provided on an "as is basis. Larry Nylund disclaims all warranties relating to the software, whether expressed or implied, including but not limited to any implied warranties of fitness for a particular purpose. Neither Larry Nylund nor anyone else who has been involved in the creation, production, or delivery of the software shall be liable for any indirect, consequential, or incidental damages arising out of the use or inability to use such software, even if Larry Nylund has been advised of the possibility of such damages or claims. The person using the software bears all risk as to the quality and performance of the software.
